STATES TO JOIN LEGAL PROBES OF BIG AG MERGERS According to the St. Louis Post-Dispatch, U.S. state attorneys general have joined a federal antitrust probe of the planned merger between DuPont and Dow Chemical Co., and a separate group of state attorneys general are expected to join a probe of Bayer AG’s $66 billion plan to buy Monsanto Co. EUROPEAN SEED ASSOCIATION WELCOMES CLARIFICATION OF PATENT LAW The European Seed Association “welcomes and very much appreciates” the European Commission’s clari- fication that it was not the intention of the EU legislator to provide for patent protec- tion for products (plants and plant parts) that are obtained by essentially biological processes. The Commission notes the decision of the EPO’s Enlarged Board of Appeal is based on an inter- pretation of the European Patent Convention and that an analysis and interpretation of the EU Directive 98/44 may lead to a different inter- pretation.
