Dow AgroSciences may challenge a San Francisco court decision made last week to cancel Environmental Protection Agency (EPA) approval of products containing the neonicotinoid insecticide sulfoxaflor.
In a statement, the company says it “respectfully disagrees with the Ninth Circuit’s conclusion that EPA’s registration of products containing sulfoxaflor should be vacated. Dow AgroSciences will work with EPA to implement the order and to promptly complete additional regulatory work to support the registration of the products. Dow AgroSciences is also considering its available options to challenge the Court’s decision.”
The U.S. Ninth Circuit Court of Appeals ruled EPA did not have sufficient data when it approved sulfoxaflor in 2010. Sulfoxaflor is the active ingredient found in Dow AgroSciences products Transform WG and Closer.
